By accessing or using ClockZen ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

ClockZen is a time tracking and productivity application that helps users track their time, analyze their productivity patterns, and build better work habits. The Service includes:

  • Web application
  • Desktop application for macOS
  • Browser extensions
  • Mobile applications (when available)
  • Related services and features

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any conduct that we determine, in our sole discretion, is harmful to the Service or other users.

  • Attempt to gain unauthorized access to the Service or its related systems

5. Subscription and Payments

Free and Paid Plans

ClockZen offers both free and paid subscription plans. Features available to you depend on your chosen plan. We reserve the right to modify the features included in each plan.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for the subscription fee. All fees are non-refundable except as required by law or as expressly stated in these Terms.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan.

Price Changes

We may change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

6. Intellectual Property

Our Rights

The Service and its original content, features, and functionality are owned by ClockZen and are protected by international copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of any data you create or upload to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely to provide the Service to you.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the practices described in our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not make any warranties regarding the accuracy or completeness of any information provided through the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CLOCKZEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ClockZen and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of San Francisco County, California.

12. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
